Terms and Conditions (United Arab Emirates)
These Terms and Conditions (“Terms”) govern access to and use of the Elberith platform within the United Arab Emirates (UAE). By accessing or using the Platform, you agree to be bound by these Terms.
1. Definitions
- “Platform”: Elberith website, applications, and systems
- “User”: any person accessing the Platform
- “Customer”: any person making a booking
- “Operator / Partner”: independent provider offering services via the Platform
- “Services”: Ride/Taxi, Chauffeur, Courier, Freight, and Flight bookings
2. Nature of the Platform
Elberith is a technology marketplace that connects Customers with independent Operators. Elberith does not own vehicles, employ drivers, operate aircraft, or directly provide transportation or logistics services.
Operators act as independent contractors and are solely responsible for the services they provide.
3. Eligibility
Users must be at least 18 years old and legally capable of entering into binding contracts under UAE law.
4. Account Registration
Users must provide accurate and complete information when creating an account and are responsible for maintaining the confidentiality of login credentials.
5. Bookings and Payments
All bookings must be made through the Platform. Payments are processed securely. Prices may vary based on demand, distance, location, and service type.
6. User Responsibilities
Users agree to:
- Provide accurate booking details
- Comply with all applicable UAE laws and regulations
- Not misuse the Platform for unlawful or fraudulent purposes
7. Operator Responsibilities
Operators must:
- Hold all required licenses, permits, and insurance as mandated by UAE transport and aviation authorities (including relevant Emirate regulations)
- Deliver services safely and professionally
- Comply with applicable transport, aviation, and logistics regulations
8. Cancellations and Refunds
Cancellations and refunds are governed by Elberith’s Refund & Cancellation Policy applicable to each service category.
9. Limitation of Liability
To the maximum extent permitted by UAE law, Elberith shall not be liable for:
- Acts or omissions of Operators
- Delays, accidents, loss, or damage during service delivery
- Indirect or consequential losses
10. Indemnification
Users agree to indemnify Elberith against claims arising from misuse of the Platform or breach of these Terms.
11. Intellectual Property
All Platform content, software, branding, and materials are protected by intellectual property laws.
12. Data Protection and Privacy
Use of the Platform is subject to Elberith’s Privacy Policy and applicable UAE data protection laws, including Federal Decree-Law No. 45 of 2021 on Personal Data Protection.
13. Suspension or Termination
Elberith may suspend or terminate accounts for violations of these Terms.
14. Dispute Resolution
Parties shall first seek amicable resolution. If unresolved, disputes shall be subject to the jurisdiction of the courts of the UAE.
15. Governing Law
These Terms are governed by the laws of the United Arab Emirates.
16. Amendments
Elberith reserves the right to modify these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.
