Terms and Conditions (UK)
These Terms and Conditions (“Terms”) govern your access to and use of the Elberith platform, website, applications, and services (collectively, the “Platform”) operated by Elberith Group (“Elberith”, “we”, “us”, “our”), a company established in the United Kingdom.
By accessing or using the Platform, you agree to be legally bound by these Terms.
1. Definitions
- User: Any person booking or using services through the Platform.
- Operator / Partner: Transport, chauffeur, courier, freight, or flight service provider fulfilling bookings.
- Affiliate: A person or entity promoting Elberith services for commission.
- Services: Ride/Taxi, Chauffeur, Courier, Freight, and Flight booking services.
- Booking: A confirmed service request made via the Platform.
2. About Elberith
Elberith is a technology platform that connects Users with independent Operators and Partners. Elberith is not a transport carrier, courier company, freight handler, airline, or travel agent. Services are delivered by independent Operators.
3. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to use the Platform.
4. User Accounts
You are responsible for:
- Providing accurate information
- Maintaining account confidentiality
- All activity under your account
We may suspend or terminate accounts for misuse or breach of these Terms.
5. Nature of the Platform
Elberith acts as an intermediary technology provider. The service contract for any Booking is between the User and the relevant Operator.
Elberith is not liable for operational execution of services.
6. Bookings and Payments
- All Bookings must be made through the Platform.
- Prices are displayed before confirmation.
- Payment must be made in advance unless agreed otherwise.
- A Booking is confirmed only after payment is successfully processed.
7. Cancellations and Refunds
Cancellations and refunds are governed by the Refund & Cancellation Policy published on the Platform, which forms part of these Terms.
8. Operator Responsibility
Operators are solely responsible for:
- Licenses, insurance, and legal compliance
- Service quality and punctuality
- Safety of passengers, goods, and deliveries
Elberith does not control vehicles, drivers, routes, or handling of goods.
9. Prohibited Use
You agree not to:
- Misuse the Platform
- Attempt fraud or payment abuse
- Harass Operators or staff
- Reverse engineer or disrupt the Platform
10. Intellectual Property
All content, branding, software, and materials on the Platform are owned by Elberith. You may not copy, distribute, or reuse without permission.
11. Limitation of Liability
To the maximum extent permitted by law, Elberith shall not be liable for:
- Delays, cancellations, or service failures by Operators
- Loss or damage to goods during courier/freight services
- Missed flights or appointments
- Indirect or consequential losses
Our total liability shall not exceed the amount paid for the Booking.
12. Indemnity
You agree to indemnify Elberith against any claims arising from:
- Your misuse of the Platform
- Your breach of these Terms
- Disputes with Operators
13. Suspension and Termination
We may suspend or terminate access without notice if you breach these Terms or misuse the Platform.
14. Privacy
Your data is handled according to our Privacy Policy.
15. Changes to Terms
We may update these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of the United Kingdom.
Any disputes shall be subject to the exclusive jurisdiction of the courts of London.
17. Force Majeure
Elberith is not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, strikes, war, pandemics, or government restrictions.
18. Severability
If any provision is found invalid, the remaining provisions remain in effect.
19. Entire Agreement
These Terms, together with referenced policies, constitute the entire agreement between you and Elberith.
