These Terms and Conditions govern access to and use of the Elberith platform and services within the United States. By using the platform, you agree to be bound by these Terms.
Definitions
- “Platform” means the Elberith website, apps, and systems.
- “User” means any individual or entity using the Platform.
- “Customer” means a person booking a service.
- “Operator / Partner” means a service provider offering transport, chauffeur, courier, freight, or flight services through the Platform.
- “Services” include ride/taxi bookings, chauffeur services, courier, freight, and flight bookings.
2. Nature of the Platform
Elberith is a technology marketplace that connects Customers with independent Operators. Elberith does not own vehicles, employ drivers, operate aircraft, or provide transportation or logistics services directly.
Operators are independent contractors and are solely responsible for the services they provide.
3. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts under applicable U.S. law to use the Platform.
4. Account Registration
Users must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.
5. Booking and Payments
All bookings must be made through the Platform. Payments are processed securely through Elberith’s payment systems. Prices may vary depending on distance, demand, location, and service type.
6. User Responsibilities
Users agree to:
- Provide accurate booking information
- Behave lawfully and respectfully toward Operators
- Not misuse the Platform for illegal or fraudulent activities
7. Operator Responsibilities
Operators must:
- Hold all licenses, permits, and insurance required by federal, state, and local law
- Provide services safely and professionally
- Comply with all transportation, aviation, and logistics regulations applicable in their jurisdiction
8. Cancellations and Refunds
Cancellations and refunds are governed by the Elberith Refund & Cancellation Policy applicable to each service category.
9. Limitation of Liability
To the maximum extent permitted by law, Elberith shall not be liable for:
- Acts or omissions of Operators
- Delays, accidents, losses, or damages occurring during service delivery
- Indirect, incidental, or consequential damages
10. Indemnification
You agree to indemnify and hold Elberith harmless from any claims, damages, or expenses arising from your misuse of the Platform or violation of these Terms.
11. Intellectual Property
All content, branding, software, and materials on the Platform are the property of Elberith and protected by U.S. intellectual property laws.
12. Privacy
Use of the Platform is subject to the Elberith Privacy Policy, which explains how personal data is collected and processed.
13. Termination
Elberith may suspend or terminate accounts for violations of these Terms without prior notice.
14. Dispute Resolution
Any disputes shall first be attempted to be resolved amicably. If unresolved, disputes shall be subject to binding arbitration under the rules of the American Arbitration Association.
Class action lawsuits are waived to the extent permitted by law.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State in which the dispute arises, without regard to conflict of law principles.
16. Changes to Terms
Elberith reserves the right to update these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.
